- Rates: Current rates can be seen here.
- Standard Rate Definition: Any reference to the term “standard rate” within the websites yourpersonal.ninja or ustech.ninja or in any Statement of Work (SOW) refers to $190/hour, with a minimum of one hour billable. This rate applies to all services unless otherwise specified in a specific SOW or agreement.
- Commitment Periods on Statement of Work (SOW) Modifications: Any Statement of Work (SOW) with an Annual Commitment or Two-Year Commitment entails a one-year or two-year commitment, respectively, effective from the date any modifications are made. This includes adjustments to the user count. If the number of users is increased or decreased, the commitment term resets to a new one-year or two-year term from the date of the change, replacing any prior commitment term.
- Reversed Transactions and Recovery Costs: Reversed Credit Card Transactions, Reversed ACH Transactions, or Bounced Checks will incur a fee of $200 per transaction. Additionally, time spent recovering funds related to a reversal will be charged at our standard hourly rate.
- Transition to Another Technology Provider: Any time spent related to transitioning to another technology provider, including but not limited to data migration, consultation, and coordination, will be billed at a rate of up to two times our standard hourly rate, depending on the complexity and time requirements.
6.Breach Response and Administrative Overhead: Material breaches of this Agreement require specialized administrative protocols and account management escalation. Client agrees to the following liquidated damages representing Provider’s reasonable forecast of additional costs:
- a) Administrative overhead for breach documentation and response: 4 hours minimum at double standard rate ($760)
- b) Account management escalation fees: $200 base fee plus $50/day breach remains uncured
- c) All time spent on breach resolution activities: double standard rate ($380/hour)
- d) Legal consultation and collection preparation: actual time at double standard rate
These amounts represent Provider’s genuine pre-estimate of administrative costs, business disruption, and specialized resources required for breach remediation.”
